KONE Spares can be used by registered elevator and escalator companies. Via KONE Spares we do not supply goods or services to private persons or end-customers outside the elevator and or escalator industry and therefore the on-line ordering functions can only be accessed by registered elevator and escalator companies. All other customers, please contact your local KONE company to purchase the spare parts you need. 1. Scope / General
These terms and conditions include the terms and conditions applicable to the use of this KONE Spares web application and the purchase of spare parts via KONE Spares. The seller of the spares parts is KONE Industrial Ltd (“Seller”). The Seller’s contact information is the following:

When using KONE Spares and/or purchasing spare parts via KONE Spares, the Customer accepts these terms and conditions. The use of any other terms and conditions, such as those of the Customer, is expressly excluded.
2. Offers and confirmations
All offers are non-binding as to pricing and shipping availability. All orders placed become valid only upon receipt by the Customer of a written (email) confirmation from the Seller. The Seller makes no warranties as to the veracity or accuracy of illustrations, drawings, diagrams, weights or other technical data or electrical values given in KONE Spares.
3. Delivery times
Delivery times are normally given as DAP to destination (Incoterms 2010) and are not binding. Unforeseen hindrances such as force majeure, industrial disputes, malfunctions of any kind, transport difficulties etc. entitle the Seller to rescind the Seller’s delivery obligation either in whole or in part. The Customer’s right to claim damages or compensation in such cases is excluded.
Prices given are not binding and are given in euros ex-works Herten, Germany excluding VAT, which will be invoiced separately. The Seller expressly reserves the right to change the prices given in KONE Spares at any time. Prices for transportation can also be seen online. These are also non-binding, since weights of actual parts and actual consolidation of packages can deviate and hence affect the actual transportation price.
Deviations in stock may appear and therefore the Seller does not guarantee the availability of spare parts quoted in KONE Spares.
6. Minimum order value / Surcharges
Minimum order value excluding VAT for all Customers is 50 euros per order.
Packaging is included in the price, unless otherwise stated. Packaging is non-returnable.
Shipment is at the Seller’s discretion and no guarantee of the cheapest available method being used is given. Normal well known shipping companies are used (for example UPS, TNT or DHL). The orders are shipped at the Customer’s risk.
9. Limitation of liability
Except as required by applicable law, the Seller shall not be liable for any direct, indirect, incidental, special or consequential damages, lost profits or for business interruption arising out of the use of or inability to use KONE Spares or sale or delivery of spare parts via KONE Spares, even if KONE has been advised of such damages. KONE shall not be liable for any inaccuracies, delays or failures contained in KONE Spares, and shall not be obligated to notify users when information has been updated. KONE is not responsible for any loss or damage that is caused by your reliance on any data or services contained in KONE Spares or data that the user has input into KONE Spares.
KONE’s liability for any and all damage arising out of or relating to KONE Spares and spare parts sold and delivered through KONE Spares is limited to the price of the spare parts to which the damage relates to.
10. Returning spare parts
The Customer has a right to return fault-free spare parts subject to this being exercised within twenty (20) working days after the spare parts have been shipped to Customer. The measure point is the date of the spare parts issue in the Seller’s warehouse. Customer must contact the Seller prior to the actual return of the spare parts to indicate the Customer’s wish to return the spare parts (RMA). The spare parts to be returned must be received by the Seller within a twenty (20) working day period. If this right to return spare parts is exercised by the Customer, the Seller will invoice the shipping and packaging costs incurred by the Seller and 15 euros for processing. Electronic components (e.g., PCBs), or those whose fault-free condition cannot be ascertained without exhaustive technical testing, are excluded from this principle and cannot be returned to the Seller. Return shipment is at the risk and expense of the Customer. All return shipments must be accompanied by the Seller’s delivery note or invoice.
11. Payment conditions
For one-time Customers and Customers purchasing a small number of spare parts, the Seller requires a 100% down payment with a credit card. In all other cases, unless otherwise agreed, payment is due in full within 30 days of invoice issue.
12. Electronic boards
All electronic boards are supplied tested and sealed by their manufacturers or by the Seller. Once the seal has been broken the board cannot be returned as the Seller has no means of testing electronic boards and the Seller cannot resell electronic boards.
13. Applicable law; Place of jurisdiction
KONE Spares, these terms and conditions of business and all orders placed and purchases executed via KONE Spares shall be governed by the laws of Finland. Any dispute, controversy or claim arising out of or relating to KONE Spares, these terms and conditions of business and all orders placed and purchases executed via KONE Spares contract, or the breach, termination or validity thereof shall be finally settled by arbitration in accordance with the Arbitration Rules of the Finnish Central Chamber of Commerce by one (1) arbitrator appointed in accordance with the said rules. The arbitration shall take place in Helsinki, Finland in English language.
